The Federal Gender Equality Act(LPar) has been revised and now requires employers with a workforce of more than 100 to conduct an in-house equal pay analysis.

The LPar addresses all employers, regardless of whether they belong to the private law or public law sector (Art. 2 LPar). Both the analysis and verification obligations therefore apply to both sectors.

The amendment went into effect on July 1, 2020 and aims to enforce the right to equal wages for work of equal value enshrined in the constitution (Art. 8 para. 3 Const.).

What does the equal pay analysis review consist of? Concretely, the review consists of three steps: equal pay analysis, equal pay verification by an independent third party, and informing employees about the result of the analysis. Only those persons who have attended the appropriate training course corresponding to the Federal Council's criteria (Art. 13d para. 2 LPar) and provide proof of this to employers can perform the equal pay analysis review.
